Minimizing Joint Employer Risks

With state and federal agencies focusing on joint employment issues, OWA members are advised to review a new resource from our legal counsel Davis Wright Tremaine: Avoiding Contractual Missteps: Wine and Workers in a Joint Employment World. Many growers are reviewing contract language to address liability risks when using labor contractors to ensure labor providers are in compliance, especially in light of the Oregon Sick Time Law that went into effect Jan. 1. You may be up to speed, but are your labor providers in compliance?

As a starting point, some growers are incorporating language such as this: Contractor agrees it is solely responsible for ensuring compliance with all federal, state, and local laws applicable to Services performed for Company, including, without limitation, paying wages, benefits, taxes, and required insurance; posting signage and notices; complying with hiring laws including immigration and background checks; protecting worker health and safety; granting required meal and rest breaks; accruing, granting, and recording paid leave under the Oregon Sick Time Law; and ensuring the work environment is free of harassment, discrimination, and retaliation based on any protected status.
 
Remember, all contracts should be reviewed and modified based on individual circumstances. Inserting sample language into one part of an agreement without considering other contract provisions or realities in the vineyard may not be effective and can even introduce serious problems. Growers should consult legal counsel for specific advice about their specific circumstances and contracts.
